Joe Rogan has become one of the most recognizable public figures associated with cannabis. On episodes of The Joe Rogan Experience, which is produced from his studio in Austin, Texas, Rogan has openly discussed marijuana, hemp-derived cannabinoids and psychedelics, and he has occasionally been seen consuming what appears to be cannabis or cannabis-related products during interviews.
You have to ask why Joe Rogan can consume cannabis in Texas while most Texans can’t. The answer lies in a combination of legal nuance, uncertainty, wealth and public perception.

Texas continues to prohibit recreational marijuana. The state’s Compassionate Use Program allows only limited access to low-THC medical cannabis for qualifying patients with specific medical conditions. Possession of traditional marijuana outside the program can still carry criminal penalties. Rogan has long argued cannabis should be legal nationwide. Throughout hundreds of podcast episodes, he has described marijuana as less harmful than alcohol for many adults, questioned criminal penalties for cannabis possession and advocated allowing responsible adults to make their own decisions. His position has remained remarkably consistent for years, regardless of where he has lived or recorded.
The consistency stands in sharp contrast to the ongoing debate within Texas.
While lawmakers have maintained tight restrictions on marijuana, they have also spent years debating the future of hemp-derived THC products. At one point, Texas became one of America’s most innovative markets for hemp beverages and other cannabinoid products, attracting entrepreneurs and investment before legislative proposals created significant uncertainty for the industry.
Critics argue the situation creates an appearance of unequal treatment. But politicans are indifferent to a two tier system when it includes friends.
A globally recognized celebrity like Joe Rogan can openly discuss cannabis, display cannabis-related products and make marijuana part of his public brand with relatively little apparent controversy. Meanwhile, many ordinary Texans remain uncertain about what products are legal, what could result in criminal charges and how changing state policies might affect them.
Supporters of Texas’ current approach respond the law applies equally to everyone and public appearances or podcasts alone do not establish whether someone is consuming an illegal substance. Rogan regularly says it is marijuana, but those who want to intoner share hemp-derived products can closely resemble marijuana.
