DeSantis Thwarted In Florida Marijuana Court Ruling

 

Score one for the voters

Florida Governor Ron DeSantis has been clear about his views on marijuana. He has called recreational cannabis a problem, lamented marijuana’s “stench” and grimly warned drugs are killing this country. After voters approved medical marijuana, he said it wasn’t enough and made them vote again where it passed by 71%. Despite his campaign receiving major funds from a few large players in the industry, his public state has been consistent.  As Florida put together a ballot initiative to legalize recreational, DeSantis signaled his displeasure. Ashley Moody, the attorney general of Florida and ally of Gov. Ron DeSantis, asked the state Supreme Court to nix a proposed constitutional amendment which would legalize recreational cannabis.

Today, in a 5-2 ruling, the Florida State Supreme Court advanced a proposed adult-use cannabis legalization initiative to the November 5, 2024, ballot. This delivers multi blows to the governor as it dismisses his and the state attorney general argument.  Marijuana, along with another ballot initiative are on the ballot and it is sure to drive voters who may not vote in line with DeSantis’s goals. And it shows despite his posturing, his administration, including the courts, are not in lockstep.

“This is one of the most important cannabis legalization campaigns in recent years,” said Matthew Schweich, executive director of the Marijuana Policy Project. “We have the opportunity to end the injustice of cannabis prohibition for over 22 million Americans.”

The ballot initiative, which is being spearheaded by Smart and Safe Florida, would legalize cannabis for adults 21 and over and allow legal sales through licensed businesses. In order to pass, the initiative must be approved by 60% of voters. Of the 24 states with an initiative process, Florida is the only state that requires 60% to pass an initiative.

If the ballot hits the 60% approval mark, the initiative would take effect six months after Election Day. The initiative would allow adults 21 and older to possess up to one ounce of cannabis flower and five grams of concentrate. Medical cannabis dispensaries would be permitted to sell cannabis to adults over the age of 21. The legislature would retain the ability to issue more licenses in the future.

Gov. Ron DeSantis appointed five of the seven justices. One justice said were “baffled” by the state’s argument about the language being misleading, and other justices were similarly skeptical of the state’s push against the amendment. This signals another blow  the court ruling against the governor’s stated position.

As of this time, neither the Governor or the State Attorney General have provided feedback.

How To Manage When Only One Partner Consumes Weed

Compromise 

Compromise can appear in many ways, by either consuming on days when you’re apart, trying out non-intoxicating strains or indulging on special occasions and having your partner understand why you’re doing it. If the smoke is the issue, there are plenty of other less invasive options to choose from. The most important part here is to communicate.

Is it opening the door to a new era? It seems the Biden administration has suddenly decided to follow up on their 2020 campaign promises. But does the sense of urgency reflect not only their need to engage younger voters but something else? Is the administration racing to reschedule by 4/20. President Biden brought up federal rescheduling as part of his proclamation declaring April to be “Second Chance Month.”  Followed by his mentioning it in the State of the Union, this should be a signal to the Federal Drug Agency (FDA) to move on the recommendation by other agency and act.

Having made the promise, for almost the first 3 years of his tenure, Biden barely acknowledged the cannabis industry. This despite sales in the industry continues to grow and now, over 50% of the country has legal access to products.  Those under 40 have an entirely different take on marijuana with Gen Z drifting away from alcohol and moving to weed.  Beer sales have mirrored the societal shift. They have been out of step with the public.

Biden is struggling with younger voters. Media like the New York Times has been piling on by highlighting why he is losing and gently making it a much bigger issue.  The campaign is concerned and sees to reengage this demographic. Biden is viewed favorably by only 31% of people ages 18 through 29, much worse than he fares with other age groups, according to a recent Economist/YouGov poll.

The White House begrudgingly started the process of rescheduling last year.  Currently, cannabis classified as having zero medical benefit is lumped into the same category as heroin and LSD.  Neither alcohol or tobacco are boxed into this category despite having zero health benefits and litany of problems the does cause.

Rescheduling would be an immediate benefit to an industry struggling with a host of issues including tough business rules around the classification, chaos in the New York and California market, and a dropping of flower prices.  Some older Senators including James Risch (R-ID) and Pete Ricketts (R-NE) are making a last ditch effort to stop the process.

While 4/20 has long been a wink wink nod to marijuana use for those in the know, thanks to the legal sales it is another big media day.  Like the 4th of July or Drinksgiving/Green Wednesday, it is a time where they could get the most engagement with the public.

A couple of things to remember if you give a special treat. Most edibles will be in a 2.5-10 mg.  If they are a canna-newbie, make sure they wait 30-45 minutes after eating to allow time for the body to absorb the marijuana.

Of course, you can go old school and make special brownies.  If you do, if you have a couple of choices. Cannabutter is a classic choice for marijuana brownies. Simply swap a portion of the butter requirements with cannabutter. Canna-oil the other option for baking. Like cannabutter, replace the oil in the recipe or augment the oil’s amount by mixing it with canna-oil.

Ingredients

  • 4 oz unsweetened chocolate
  • 3/4 cup cannabutter
  • 2 cups sugar
  • 1 cup flour
  • 3 eggs
  • 1 tsp vanilla extract
  • 1 13 x 9 baking pan lined with aluminum foil

Create

  • Preheat oven to 350 degrees
  • In a microwave-safe bowl, melt the chocolate and cannabutter together
  • After your chocolate and cannabutter are smoothly combined, blend in other ingredients
  • Ensure a uniform batter, creating the perfect brownie consistency and potency
  • Gently pour your brownie batter into your foil-lined baking tray
  • Bake for 35 minutes or until  until the edges are firm, and the center is slightly gooey
  • Cool and serve

Ingredients

  • 2 oz tequila perhaps a blanco
  • 4 oz pineapple juice
  • Splash of cranberry

Create

  • Add add to a highball glass
  • Pour in tequila and pineapple juice
  • And a splash of cranberry juice for color
  • Stir and enjoy!

The Peep-a-lious

Peeps are iconic to Easter since the Just Born company premiered the colorful confection in the 1950s.  Why not combine a classic with vodka and make it even more enjoyable.  Consider reviving a childhood tradition but instead of dying eggs, you color champagne.

  • Add the milk and whisk the mixture over medium-low to medium heat until the sugar and cocoa are dissolved and the hot chocolate is heated through

America’s Sports Betting Bonanza Explained

As with marijuana laws, sports betting takes on different shapes, depending on the state.

Until quite recently, Americans could only legally bet on sports by traveling to a brick-and-mortar sportsbook in Nevada and exchanging physical currency for a slip detailing their wagers.  That was then.

In a landmark 2018 ruling, the U.S. Supreme Court struck down the Professional and Amateur Sports Protection Act (PASPA), which previously restricted wagering on sports other than horse and dog racing (which employ parimutuel systems akin to peer-to-peer pools) to Las Vegas, Reno, and other Nevada locales. The court’s decision cleared the way for every state to legalize sports betting. New Jersey was the first to do so in 2018 and, since then, about 30 more have followed suit.

But as with marijuana laws, sports betting takes on different shapes, depending on the state. Some, like Washington, restrict such betting to tribal gaming properties. Others, like Tennessee, only offer mobile sports wagering, with bettors forced to use their phones or computers to get bets down instead of visiting a retail sportsbook. Most fall somewhere in between, and some really big ones, like California and Texas, have yet to legalize sports betting. (Naturally, Florida continues to be a nanny state.)

If you live in a state where sports betting’s not legal, it’s perfectly permissible to hit the interstate until you cross into a state where such wagering is legal, pull off at the first exit, download an authorized sportsbook app like DraftKings or FanDuel, place bets on your phone, and drive back home. That really, truly happens — a lot. And until New York launched mobile sports wagering shortly last month, Big Apple residents often biked to the middle of the George Washington Bridge, where they were technically in New Jersey, to get their bets down in a de facto al fresco sportsbook before pedaling back to their abodes.

As for the betting itself, it’s best to crawl before you (hopefully) sprint to the bank. In fact, if you have the mobility and means, it’s probably best to place your first bet in person at a sportsbook — namely Circa or the Westgate SuperBook — in Las Vegas, where patient, professional oddsmakers and tellers will be happy to walk you through the process and what all those numbers mean. Short of that, if you have access to a brick-and-mortar sportsbook within driving distance of your home, head there and have someone show you the ropes.

But if you’re determined to shun the IRL experience and bust out your phone to bet on the Super Bowl, remember that “risk-free bets” are typically anything but. By all means, take advantage of the plethora of mobile sportsbook promotions; they’re in the midst of a massive customer-acquisition cockfight, and unafraid to dole out free money to bludgeon rival birds. But if you don’t know what you’re doing — like, if you make a parlay bet without knowing what a parlay is, or wager with an offshore sportsbook without realizing you’ve just entered a very gray (bordering on black) market — it’ll soon be your money, not theirs, that you’re sacrificing.

Some helpful pointers heading in: Plus money — i.e., taking the Bengals on the moneyline at +170 — will pay far more handsomely than negative juice (i.e., taking either side of the Bengals-Rams spread at -110). And if you’re picking the moneyline, you’re picking the Bengals to win the game, period, regardless of what the point spread (Rams by 4 to 4.5, depending on what sportsbook you visit) is. That’s why you’re getting the plus money, because betting on the underdog to win is riskier than betting on them to lose by less than four points.

Parlays — where two or more betting events have to happen in order for your ticket to cash — might be where the big bucks are made, but smart money always wins. Start slow, be responsible, and don’t chase your losses. Predetermine how much money you’re willing to lose in one sitting and stop wagering when you reach that amount. Study what you’re betting on before you bet on it.

Do all this and, eventually, sports betting could become a lucrative hobby or, at worst, a fun, low-cost diversion on par with a Friday-night bar tab.  Today, roughly 43% of Canadian and Americans do it.

Looks Like Virginia Is The Newest Marijuana Nanny State

Some politicians believe the majority of the public are confused or just smart.  They feel it is important to step in and change things.

It seems the nanny state is on the rise!  Following Florida and Texas, Virginia seems to think their citizens are “confused” about what they want and their highest elected officials need to take care of a populace unable to care for themselves. Singapore, Korea and China are big examples of nanny states, but the trend is become popular in the United States.

A perfect example is around legalized marijuana. According to Pew Research Center, an overwhelming 88% of U.S. adults say either that marijuana should be legal for medical and recreational use by adults (59%) or that it should be legal for medical use only (30%). Only one-in-ten (10%) say marijuana use should not be legal.  It has become an almost $30 billion industry and a proven revenue driver for states. Consumer numbers show the stigma is gone. But some states aren’t having it.

A few states feel they are better run by parental figures who know better.  These include Florida where over 71% of the public voted for marijuana but the current Governor does everything to block it.  Not to be outdone, Texas jumped on the bandwagon.  Meanwhile, in a fact based world, the Department of Veterans Affairs changed policy for veterans so they can use medical marijuana without losing their eligibility for care and services. The change was based on science, data and need.  Despite the step forward for veterans, it seems now it looks like Virginia is the new newest marijuana nanny state.

In a messy fight, the Old Dominion Governor Glenn Youngkin has made it clear he has no intention of allowing legal marijuana. The tourism slogan is Virginia is for Lovers, but the top elected official is showing any for cannabis, even as some of his allies soften their stance.  No doubt there are looking at states like Missouri who are pulling in significant amount of tax revenue.

Texas Gov. Greg Abbott doesn’t care polls reveal a majority of Texans support legalizing marijuana for medical and recreational use. Abbott stated his position has not changed beyond what he’s proposed in the past — reducing the criminal penalty for marijuana possession to a Class C misdemeanor, but not legalizing the drug.

Texas embraces his policies which include going days without power and voters in Houston votes no longer count.
