Young Americans Turn To Marijuana Over Tobacco

The new data reveals a changing perspective on smoking tobacco, a number that has dropped from 45% in the 1950s to 15% in 2019.

Although the legalization of cannabis has been a slow moving process, a new Gallup poll suggests that young Americans might be reaping some of the benefits. The poll finds young Americans are turning to marijuana over tobacco.

Over the past four years, the amount of Americans who consume marijuana has been at a steady 12%. The new data reveals a changing perspective on smoking tobacco, a number that has dropped from 45% in the 1950s to 15% in 2019.

Those aged between 18 and 29 are more likely to smoke marijuana over cigarettes and changing the landscape. This change is a result of many factors, such as the evolving conversation surrounding marijuana and the new found support for its medicinal value. At the same time, it’s also a tough moment for the tobacco industry. Aside from the undeniable negative side effects that come with smoking, the tobacco industry has also received negative criticism over their marketing strategies and the fact that they target neighborhoods of lower incomes.

“The once commonplace habit of cigarette smoking has dwindled to the point that fewer than one in seven Americans smoke,” Gallup explains. “And although smoking has long been associated with lower socio-economic groups, smokers are now an exceedingly rare breed among upper-income and highly educated Americans.”

The poll points out that despite marijuana’s legal status, adults under the age of 30 still prefer it over smoking cigarettes. Adults over this age don’t share this perspective, being more likely to smoke cigarettes than marijuana.

The future of the U.S. tobacco industry continues to grow more complex, with a large focus on the e-cigarette industry, which only recently began to be regulated by the FDA. While many believe e-cigs are a safer alternative than tobacco, authorities are concerned by the amount of teens that are partaking, and the ease with which these tools can bypass security measures.

How does one go about getting his or her minor marijuana conviction erased from their permanent record? Here are the basic details.

When Illinois legalized marijuana for recreational use, not only did the language of the law give adults 21 and over the freedom to buy the herb from retail outlets just as they have done for decades with beer, it also provided those people with pot-related convictions the opportunity to have their records wiped clean.

The Cannabis Regulation and Tax Act include a provision that gives people with low-level convictions for marijuana possession the right to petition the court to have their records expunged. It’s all part of the state’s reparations package designed to make up for years of marijuana prohibition. But who qualifies for expungement? More than that, how does one go about getting his or her minor marijuana conviction erased from their permanent record?

Here are the basic details:

Who Qualifies for Expungement?

Expungement is an exciting process, as it gives people with certain types of convictions the right to have their criminal records destroyed or returned to them and banned from public record. In the case of Illinois, the law now allows those who were convicted of possession of between 30 and 500 grams of marijuana this right. The provision even includes convictions for manufacturing and intent to deliver. As long as there was no violence associated with the offense, cannabis convicts can ask the court for clemency. Some of the latest data shows that Illinois could end up clearing the records of around 800,000 pot offenders as a result of this portion of the law.

How To Get Your Record Expunged

If a person believes they qualify for expungement, they will first need to file a petition with the circuit clerk in the county where the arrest happened and the charges were filed. So if you live in Wabash County but got busted for marijuana possession in Cook County, the petition will need to be filed with the Cook County Circuit Clerk. And let’s say you were one of those unlucky folks that have been convicted of petty pot charges in multiple counties. Well, a petition will need to be filed for each. As with anything involving the courts, petitioners must pay a small filing fee. It would be necessary to pay this fee for each county where a petition was filed. In some cases, however, if the petitioner’s income falls below the federal poverty line, the cost can be waived.

Petitioners will need to fill out and submit a “Request to Expunge & Impound And/Or Seal Criminal Records” document along with the filing fee to get the ball rolling. Illinois Legal Aid provides an online program to help petitioners prepare the necessary documents. In some instances, these documents can be e-filed. Some courts, however, require expungement cases to be filed in person.  

From there, the clerk will make either the State’s Attorney or the prosecutor in the case aware that a petition for expungement has been filed. The law enforcement agency responsible for the arrest will also be notified. Although these officials have the right to object to a petition to expunge, it is unlikely in the case of minor marijuana possession that there would be any push back. Not since the state is motivated to clear these records as part of its reparations program. But if a person’s marijuana crime also involves a weapons charge, we wouldn’t be surprised to see an objection. Any protest to an expungement petition would need to be filed within 60 days of the clerk’s notice. 

The petitioner will then have to appear before a judge. As long as there are no objections, the court will likely grant the petition. But if a police agency does contest the petition, the judge would take those complaints into account before making a decision. Either way, it is entirely up to the judge’s discretion whether or not a petition is granted. Sometimes a request can be denied even when there is no question of eligibility. But again, the state wants to clear pot convictions. Any person who feels like their case might be contested for whatever reason should give serious consideration to hiring an attorney. They’ll give the petitioner a better chance in court.

The Difference Between Marijuana’s Sativa And Indica

If you’re buying marijuana for the first time, it can be overwhelming to step inside a dispensary. Legal cannabis has opened the floodgates for consumers with various delivery options like shatter, edibles, tinctures, and on and on. Just buying flower doesn’t necessarily simplify the process either. The differences between sativa, indica, and hybrids and their various effects can be confusing for first timers and old heads alike.

If you’re using cannabis for medical purposes, you shouldn’t so much focus on sativas and indicas at all. Instead you should worry about cannabinoids, terpenes, and other profiles found in specific strains.

The Future Of Cannabis In The UK

A complicated and difficult-to-negotiate U.K. departure from the European Union, nicknamed “Brexit,” proved too much for Prime Minister Theresa May, who resigned as PM, after several unsuccessful attempts to reach a departure deal, May has decided to step down. Unfortunately, Boris, a member of the rarefied group of public figures known by a single name, is not so hot on cannabis, despite admitting being one who partook in his youth, which is not new, as other, contemporary and prominent politicians such as Barack Obama, have also admitted to past marijuana use, without couching it as “not inhaling.”

If the issue of cannabis is a controversial one in the UK, those against reform are likely thankful for the Brexit distraction, as it means they get to ignore the question of cannabis reform.

Why Vaping Doesn’t Smell Like Skunk

Vaporizing cannabis, raw flower and oil, has grown in popularity in recent years and for good reason. Vaping is portable, the potency is stronger, and vaporizers are generally easy to use. It’s also very discrete, with some devices resembling small USB drives and many can be confused for a pen. Vaporizing also doesn’t produce the tell-tale smell of burnt marijuana flower, although there can be a faint odor of cannabis, depending on the vaping device and method.

Why vaping doesn’t smell like marijuana is in the science of how each method delivers a high. Through a process called decarboxylation, heat applied to raw flower alters the precursor tetrahydrocannabinolic acid (THCA) into the psychoactive tetrahydrocannabinol (THC). But raw flower also contains many other organic compounds, many of which, like terpenes, are also altered during combustion and responsible for burnt marijuana’s distinctive odor.

Vaporizing cannabis oil works a little differently. Vaporizers heat up oils and concentrates to a temperature that converts THCA to THC without burning it. Flower vapes also designed to heat up buds only enough to initiate the chemistry that makes the high happen.

For as stealth as vaping is, it is not without some drawbacks. Cannabis oils and concentrates tend to be produced for maximum THC concentration, oftentimes by refining and then distilling inexpensive weed trim. Marijuana flowers have hundreds of compounds besides THC that work together to produce a high unique to smoking flower. This however is changing as concentrate producers are creating “full spectrum” oils that include terpenes,  as well as cannabinoids besides THC, such as CBD.

Another drawback are counterfeit vape cartridges and devices. Vape batteries contain batteries that can explode or cause a fire if it’s left in a high temperature area, like a locked car, or it’s exposed to air or water. Some malfunction due to poor quality. Counterfeit cartridges can contain harmful chemicals, or little to no cannabis in it. Cheaply made carts can also malfunction or leak, making whatever oil is left wasted and unusable.

Being able to conveniently and discreetly get high with a vape is great, made all the better, consistent, and trouble-free when manufacturer’s instructions are followed and you consume responsibility.

CBD Regulations Might Come Sooner Than Expected From FDA

The Food and Drug Administration (“FDA”) seems to be listening.

For the past six months, the federal agency has been bombarded with messages, urging the FDA to promptly develop a regulatory pathway for the lawful use of hemp-derived CBD (“Hemp-CBD”) in foods and dietary supplements.

Some of these messages came from Oregon’s hemp champion, Senator Ron Wyden (D), who in two occasions has publicly pressured the FDA to act on this issue.

Back in January, Wyden issued a joint letter with Jeff Merkley (OR-D), in which the Oregon senators demanded that the agency update federal regulations governing the use of certain hemp-derived ingredients in food, beverages and dietary supplements.

At the end of June, Wyden issued a second letter to the agency in which he criticized Former Commissioner Scott Gottlieb’s suggestion that it may take the agency three to five years to issue a final regulation authorizing the lawful use of Hemp-CBD in foods and dietary supplements. Specifically, Wyden explained that the regulatory confusion and uncertainties surrounding CBD could not continue much longer. To that end, Wyden recommended that the FDA adopt certain steps to streamline the regulatory process and directed the agency to issue “enforcement discretion guidance” by August 1 of this year and to follow up by issuing final rules as quickly as possible while the agency develops permanent final regulations.

In response to Senator Wyden and other stakeholders’ demands, FDA Acting Chief Information Officer, Amy Abernethy, recently announced on Twitter that:

[FDA] is expediting its work to address the many questions about cannabidiol (CBD). This is an important national issue with public health impact, & an important topic for American hemp farmers and many other shareholders.”

Abernethy went on to explain that while the agency is enthusiastic about research into the therapeutic values of CBD-infused products, it is also concerned with the need for safety.

To understand the breadth of issues and gather data on safety we have conducted a public hearing, reviewed the medical literature, and have an open public docket.”

If you recall, the public hearing to which Abernethy refers was held on May 31 and offered stakeholders a platform to share their thoughts and experience with the FDA and to stress the importance of developing a regulatory framework that would legalize the marketing and sale of CBD-infused foods and dietary supplements.

The public had an opportunity to weigh in with the FDA through July 16. Four days before the deadline, over three thousand comments had been published on the public docket. Now that the public comment period is over, the FDA will review the submitted data and anticipates reporting on its progress “around end of summer/early fall.”

Expediting the rulemaking process of CBD products will not only help clarify the legality of these products and render the cultivation and processing of hemp economically viable, it will also settle the position of many federal agencies on this issue. As we previously explained, numerous federal agencies, including the U.S. Patent and Trademark Office and the U.S. Alcohol and Tobacco and Trade Bureau, defer to the FDA in dealing with CBD-related issues.

Whether or not the FDA meets its proposed timeline, we will continue to monitor and report on its progress.

Here’s How CBD Lotion Can Help With Hives

Devoted users of CBD skincare products swear lotions and creams laced with this hemp-based cannabinoid is a killer way to care for your skin. Topical application of CBD is used to target a specific area of a body to achieve the desired results, like pain relief for sore muscles.

Some skincare products also focus on improving overall skin health, turning to CBD serums, moisturizers and oils with the hopes of younger, brighter skin. What about more practical uses for CBD topical products? Could CBD lotions be used to deal with annoying problems like hives caused by an allergic reaction?

All About Hives

Hives appear as raised bumps on the skin that are often red and itchy. They vary in size and are most often a response to exposure to something in the environment, like an allergen.

Individual hives often disappear after 24 hours. New hives may continue to appear, extending a breakout for days or even weeks. Much of the discomfort of hives is the itching, but some are also painful to touch. Treatment of hives usually involves addressing the allergic reaction with an antihistamine or steroid.

A cold compress or calamine lotion can provide temporary relief from the itching. When symptoms escalate quickly, or additional symptoms like difficulty breathing arise, emergent medical treatment is necessary.

Using CBD Lotion on Hives

Hives are an inflammatory response by the immune system. In reaction to whatever triggered the allergic reaction, the body starts releasing histamines that gather under the skin and cause inflammation.

A lotion laced with cannabidiol might provide relief from the uncomfortable symptoms of hives since CBD has been found to have anti-inflammatory properties. The endocannabinoid system is involved in the body’s anti-inflammatory response. Using CBD has been found to encourage reduced inflammation by interacting with the endocannabinoid system, according to Future Medicinal Chemistry.  

Additionally, a 2017 research review by the Journal of the American Academy of Dermatology gathered the existing research on CBD and how it affects the skin. What we know about CBD is limited, and our knowledge will hopefully increase over time, but according to this review we have determined that CBD can help soothe symptoms like itching and swelling on the skin.

Applied topically to the affected area, CBD may provide relief from symptoms, which is great for someone who is miserable after an allergic reaction. A break from itching or pain is highly desired whether you’re dealing with a small bout of hives or chronic hives lasting for weeks.

We want to be clear, however, that CBD isn’t a solo course of treatment for an allergic reaction. Follow standard protocol like heading to the ER or administering emergency medications for anaphylaxis. In the case of milder hives, avoid exposure to the trigger and follow up with a doctor if symptoms don’t resolve.
