USPS Guidance On Mailing Hemp and CBD Products

Becoming increasing popular and being sold by mainstream retailers, the USPS provided guidance on mailing hemp and CBD products.

Recently the United States Post Office (“USPS”) issued an advisory on “Acceptance Criteria for Cannabidiol (CBD) Oil and Products Containing CBD.” Those criteria are as follows:

1. A signed self certification statement, subject to the False Statements Act (18 U.S.C. § 1001). Statements must be printed on the mailer’s own letterhead, must be signed by the mailer, and must include the text “I certify that all information furnished in this letter and supporting documents are accurate, truthful, and complete. I understand that anyone who furnishes false or misleading information or omits information relating to this certification may be subject to criminal and/or civil penalties, including fines and imprisonment.”

This first prong is straight forward. The mailer must include a sworn statement that all the related documents are accurate and truthful and include the above quote indicating an understanding of the penalties that come along with lying to a federal agency.

2. The industrial hemp producer possesses a license issued by the Department of Agriculture, for the state where the Post Office/acceptance unit is located, which includes documentation identifying the producer by name and showing the mailer is authorized by the registered producer to market products manufactured by that producer.

The second prong is a little more complicated. It requires that the hemp producer hold a license from the state Department of Agriculture where the Post Office or acceptance unit is located. This statement fails to consider cases where hemp or hemp products are shipped from a state that is different than the state of cultivation. Consider an online hemp retailer operating out of New York. New York has an industrial hemp program but is not a major hemp growing state so our retailer sources products that were produced and processed in Colorado. The retailer has done her due diligence and has copies of each farmer’s license to cultivate hemp. However, based on the fact that she uses hemp cultivated in another state, it does not appear that she could comply with this prong. Her best option is likely to include copies of the Colorado licenses with her shipments.

The second prong also requires documentation showing that the mailer is authorized by the register producer to “market products.” A letter from the producer could likely satisfy this requirement but it may also prove challenging for retailers who may not have a direct relationship with the producers who are growing hemp that is used in Hemp-CBD products.

3. The industrial hemp, or products produced from industrial hemp, contains a delta-9 THC concentration of not more than 0.3% on a dry weight basis.

The third prong requires that the hemp or hemp product has less than 0.3% THC concentration. This means that both raw hemp and products derived from hemp must have a THC concentration of less than 0.3%. Usually, these test results are contained in a Certificate of Analysis (“COA”). That means that each shipment of hemp or hemp products should have the corresponding test results for that lot or batch.

Marijuana Moment first reported on the new guidance from USPS. We’ve written about how USPS lost an administrative appeal over the mailability of shipping Hemp-CBD before so it’s not as if this new guidance means that the USPS will now allow CBD to be mailed. I read the guidance to provide insight as to what the USPS is looking for when it finds a shipment of hemp or Hemp-CBD. This guidance is also only temporary and specifically states that it may be altered or rescinded as other federal agencies figure out exactly how to regulate hemp. What this letter does not do is prevent state-level law enforcement from seizing hemp shipments, as was recently the case in Idaho. State agencies are not bound by USPS memos.

For now, it’s best for industry stakeholders to try their best to comply with this guidance by providing the sworn statement, a copy of any licenses associated with hemp being mailed, and a copy of any COAs associated with the hemp or hemp products.

Cannabis Inhalers May Become The Next Asthma Medication & Cancer Pain Reliever

Asthma, lung diseases, and various respiratory issues are several reasons why people opt for cannabis consumption methods other than smoking. Although cannabis is consumed by millions of people, certain delivery methods aren’t particularly suitable because of one’s physical health. Collaboration Between Panaxia Pharmaceuticals & Rafa Pharmaceuticals

Recently, Israeli scientists have focused their efforts on creating the most effective and beneficial cannabis inhaler possible with the intent to help people with not only acute and chronic cancer-causing pain but also those with respiratory problems. Even though consuming cannabis through an inhaler is a new way to use the herb, this method is still being tested to ensure that all kinks will be resolved before the public has access to this product.

The two Israeli companies that have collaborated with each other and already got the ball rolling are Panaxia Pharmaceuticals and Rafa Pharmaceuticals. Then, not long ago, Panaxia released information about the operation of new clinical trials at the country’s Ministry of Health. The intention of conducting clinical trials is to get a better understanding about the bioavailability of cannabis via inhalers with accurately measured controlled doses.

If you know someone who might benefit from cannabis inhalers, registration for these clinical trials are now open. According to Dr. Dadi Segal, Panaxia’s CEO, the following was stated about cannabis inhalers and the product’s clinical trials:

“The clinical trial is performed as part of the registration procedure of the new products, which we are about to launch in Israel this year in collaboration with Rafa. Through access to cannabis inhalers, and subject to a medical specialist’s recommendation, we strive to help more patients suffering from acute pain. The inhaler will provide patients that are unable or unwilling to smoke the right to be treated consistently and precisely.”

How Do Cannabis Inhalers Work?

Most of you are probably familiar with traditional inhalers used by asthma patients and those with respiratory issues. How are standard inhalers different than cannabis inhalers though? For starters, all cannabis inhalers contain an attached vaporizer, which allows medical patients to fill in their ideal doses of a cannabis extract or concentrate, which will then be inhaled.

The cannabis extract or concentrate that’s added into the vaporizer will contain a measured dose of active ingredients. As a result, there will be little confusion about dosing since the patients can choose their desired dose rather than it being pre-selected for them.

Who Can Benefit from Cannabis Inhalers?

One of the main intentions of unveiling cannabis inhalers is to offer a new way for people to gain medical and therapeutic relief from cannabis and different cannabinoids. Individuals with cancer, various forms of pain, terminal illnesses, and even asthma can benefit from using these inhalers. Rather than experiencing throat irritation and/or breathing difficulties often caused by smoking, individuals can consume accurately measured doses of cannabis extracts or concentrates to experience the relief they need.

Additionally, those with debilitating or near-debilitating medical conditions, diseases, and/or illnesses can likely benefit from using cannabis inhalers once they’re available. Then, if individuals don’t want to wait more than ten minutes or so to reap the benefits they need from cannabis, cannabis inhalers can be used to experience not only fast-acting relief, but also well-being improvements.

Projected Debut Date for Cannabis Inhalers

Furthermore, the cannabis inhalers will be promoted and marketed by Rafa Pharmaceuticals while clinical trials are underway in Israel. Panaxia Pharmaceuticals also expressed that they plan on officially distributing their cannabis inhalers under the Rafa Pharmaceuticals brand.

When will these inhalers be available to the public? So far, it has been reported that they will likely be sold at different Israeli pharmacies this year. With a medical specialist’s prescription or recommendation, Israeli residents will be able to use a cannabis inhaler sometime this year to see how it can help them.

5-Ingredient Cannabutter Truffles For The True Chocoholic

Cannabis loves chocolate. The rich, dark flavor of a good semi-sweet or dark chocolate acts to mask the sometimes assertive flavor of cannabis, making it more like a pleasant herbal aftertaste. It makes for a more pleasurable eating experience, so that your edible isn’t just about getting high.

These easy cannabis chocolate truffles are a perfect starter recipe if you’ve never attempted edibles before, but they’ll prove tasty for seasoned cannabakers too. With just five ingredients, these chocolate truffles can be made in a single saucepan on the stovetop and require no baking. Almond flour adds a pleasant flavor and texture to the truffles; if you don’t happen to have any on hand, you can use any type of finely crumbled nuts, or omit them entirely; if you choose the latter option, your truffles will be slightly softer, but the recipe will still work.

Makes about 6 servings (1 truffle per serving; see recipe note below)

1. In a double boiler, or taking great care using a heavy bottomed saucepan so that the mixture doesn’t scorch, melt the chocolate and cannabutter over low heat, stirring frequently. Once the mixture is mostly melted, remove from heat and stir; the last solid bits should melt in the residual heat.

2. Fold in the almond flour and salt. This will add a nice flavor and a little texture to your truffles.

3. Let the mixture cool until it is firm enough to form into balls. This can take as long as a few hours at room temperature, depending on how warm your kitchen is. You can hasten the process by putting it in the refrigerator, but don’t let it sit too long because if it solidifies too much, you won’t be able to roll the mixture into balls in the next step. You want it to look about like this: soft, but easily scoop-able.

4. Using wet hands (to prevent sticking), roll heaping tablespoons of the mixture into balls. You should get about 6 large truffles from this mixture. You can make them larger or smaller, but be aware that this can affect dosage/potency.

5. Roll the balls in the cocoa powder, and place on a parchment-lined baking sheet. Allow them to firm; you can do this at room temperature, or speed up the process by putting them in the fridge for 15 minutes. Store well-wrapped, in a single layer, at cool room temperature or in the refrigerator.

I “dosed” this recipe with 1 teaspoon of cannabutter per serving (3 teaspoons = 1 tablespoon). End Women’s Month On A High Note With Caitlin Rose Sweet’s Queer Feminist Smokeware

Despite the growth and movement in the cannabis industry so far this year, it’s still a super male dominated industry. Sadly, the amount of women executives dropped 9 percent from 2017 to 2018, but that’s just going to make their comeback exponentially more badass. Women are contributing to the cannabis industry in countless ways, but one of the most powerful is through art, design, and visibility. 

Artist Caitlin Rose Sweet uses the medium of sculpting ceramics to widen our horizons of what exactly can be smoked out of, with pieces that range from sleek minimalism to full on labia, and it’s a delight. Her work is directly informed by her queer identity, and carving out space for women and queer people in the cannabis space is long overdue.

I caught up with the creator of The Pussy Pipe and many other iconic smokeware pieces so you can open your mind to a different type of consumption device—the artistic and cultural kind. In her own words, Sweet uses her work to “explore our relationship to the constructs of body, gender, sexuality, race, and class.” Her designs are on a full spectrum of fun to striking, but it’s all delightfully feminist, and radically queer.

What brought Sweet to create such amazing cannabis art was her own relationship to the cannabis plant. “Cannabis is a part of my self care practice for dealing with chronic health issues, and I use it recreationally. Smoking helps me connect to pleasure, leisure, and creativity,” she said.

Her creations link the function of a cannabis pipe and the beauty of visual art.

I call them High Femme Goods. These pipes are intimate scaled sculptures that focus on body and sex positivity.

Says Sweet, “High Femme Goods enhances folks’ rituals of smoking and self care. I am making from a very queer perspective. High Femme Goods line includes the Pussy Pipe, Boobie Bowl, Kushy, the Hard Femme Bubbler, Feminism Gets Me High, Bootleg Marge, and many more.”

Smoking art is not new, but it’s usually not this novel. According to Sweet, “So many creative people and makers use cannabis to access their vision and creative voice so you can see it in the work. Then there are the amazing handmade functional art objects people smoke out of. Pipe making is an ancient craft, we know so much from past civilizations based on artifacts like ceramic pipes.”

This perspective really brings home that we should really always be mindful of how we lead our lives, joy and freedom are so important to long term happiness, and that queer women deserve the space to have this, sans patriarchy. Sweet says one day an archaeologist will know about her work towards creating this paradise, “I like to think about how future beings are going to dig up all the pussy pipes i’ve made over the last four years and be like whoa our ancestors were some freaky gay stoners.”

The serious message and serious stoner stoneware are one thing, but these pipes are also downright fun. Sweet incorporates the incredibly important queer art form of camp to make items that speak to thrilling exuberance. This work breaks down barriers, I am often told by queer femme stoners that my work empowers them. My smoking vessels helps create space in the straight male dominated cannabis world for feminists, queers, and femmes. Getting high shifts our focus into our bodies and senses,” Sweet says, “Cannabis and art go together.”

3 Advertising Women Making New Careers In Cannabis

As an industry under the microscope, cannabis is revealing some interesting trends when it comes to those who work in the sector, one of which is that it’s attracting a lot of women from the world of advertising despite cannabis being almost entirely taboo in terms of its marketing. To find out what might be driving this drift, The Fresh Toast is featuring 3 advertising women making new careers in cannabis.

Blaine Pearson, Business of Cannabis

As the owner of the ad agency, Dot Dot Dash, as well as being co-founder and CMO of Business of Cannabis, Blaine Pearson has a foot in each sector.

Pearson was attracted to the cannabis space because at the time it was a nascent industry that was emerging, where the rules were being written as it evolved. “In my career, I’ve sort of always worked in new media and social and digital, so you know it just felt naturally a little bit unknown but therefore interesting,” she tells The Fresh Toast.

She thinks that women in advertising see cannabis as a tremendous creative opportunity. “And I think just the fact that it is new and interesting and there are a lot of quite interesting roles, and the sort of marketing branding conversation is one that is least defined at this point, based on the regulations, and therefore requires a great deal of flexibility and ingenuity.”

Business of Cannabis just launched a new daily show, called BoC Live (catch it on Twitter) and Pearson says she is very excited about Medical Cannabis Week which will be the second annual gathering on the topic.

Rachel Colic, Boss Ladies of Cannabis

A brand strategist since 2004, Rachel Colic has built a significant reputation in the advertising industry with YCREATIVE, but with just four years in the cannabis space, she’s launched heavy-hitting projects, like Boss Ladies of Cannabis, Eves of Eden, startup launchpad Leaf Forward, and Toronto-based licensed producer PureSinse.

When it comes to making a career change from marketing to marketing cannabis, Colic acknowledges that there is a risk but says the appeal is multi-fold. “One of the big things is you know cannabis is the next CPG and CPG is advertising. So in that sense what I think what you’re seeing is early adopters, people who are willing to take a risk.” Those that are willing to take the risk, she says, could find themselves on the ground floor of a hockey stick moment like that of the dot-com boom.

Rachel is one of the presenting speakers at year’s O’Cannabiz conference and expo, April 25-27, in Toronto.

Rebecca Brown, Crowns Agency

Rebecca Brown is the founder of Crowns, a full-service cannabis industry consultancy, but she has had a long career in marketing and advertising, including being vice president of social media and content at J. Walter Thompson.

“I have always been interested in how you hack the agency model and make it different and better,” Brown tells The Fresh Toast. “I also became very convinced while I was active in large traditional agencies that they were not the right model for the needs of most industries right now but specifically not for cannabis because that requires both specialization and speed.”

Brown sees a lack of female representation on the creative side as one factor that could be sending more women in search of new opportunities in a new space.

“[Cannabis] is attracting people from marketing and advertising perhaps who were never a fit in the first place in those environments,” Brown says.

“I think it’s unsurprising the kind of brain this space needs because it isn’t linear and you will have an easier time if your default mindset is to chart your own path because there’s nothing in place to tell you what to do you.”

Brown will also be on stage at this year’s O’Cannabiz conference.

Not only are these 3 advertising women making new careers in cannabis. Another woman shaking up the industry is Debra Borchardt from Green Market Report.  She is setting new quality and ethical standards for marijuana business reporting.

Some People Think Meghan And Harry’s Baby Will Break This Royal Record

It’s already been determined that Meghan Markle and Prince Harry’s baby will make history in several ways. Since Meghan has lived in the U.S. for a minimum of five years, her baby will have dual citizenship; he or she may be welcomed into the world during a home birth (even though it’s protocol that royals give birth at the Lindo Wing of St. Mary’s Hospital); and the newest royal will also be the first newborn to live in Frogmore Cottage.

And now, we’re learning that the baby could also make history by being the heaviest baby born into the royal family. As Hello! reports, the title of heaviest heir to the throne currently belongs to Prince Louis, who weighed 8 pounds 7 ounces. That’s just barely more than his older brother Prince George, who weighing 8 pounds 6 ounces when he was born. Their sister, Princess Charlotte, is a close third, clocking in at 8 pounds 3 ounces.

But Louis isn’t the heaviest royal. Hello! says that title belongs to Mike and Zara Tindall’s baby daughter Lena, who weighed 9 pounds 3 ounces when she was born last summer.   And before Lena came along, Peter and Autumn Phillips’ daughter Savannah held the record at 8 pounds 8 ounces.

And if the rumors are true that Kate and Meghan are competitive, Kate might actually break Baby Sussex’s potential record by having an even heavier baby, if the rumors are true that she and Prince William are trying for baby number four. Celebrate Women’s Month With These Cannabis Artists

Apparently, there’s a huge spike in Google searches for the phrase “Is there a men’s day” right on March 8 every. single. year. Pathetic! You don’t have to be a woman to know that we are exorbitantly taxed for their existence. If the men of the world are feeling under appreciated, tough Boy Scout cookies. We’re going to celebrate women by exploring some of the coolest women in cannabis art.

The cannabis industry is full of women and their ideas, expectations, and creativity, but it’s also severely lacking in women at the executive level. This also includes (or excludes) many people of color and queer people— they are just under represented in the upper echelons of the current cannabis administration.

For this reason, recognizing and uplifting women who may not be in board rooms, but are making enormous impacts on cannabis culture, is crucial this month and every month. Cannabis Artists are incredibly important to the normalization of both medical and recreational use of the plant. They interpret the feelings, moods, and sensations of cannabis use and the people who use it.

Here are two amazing cannabis artists to check out:

Visine Queen

Lisa S. (A.k.a. The Visine Queen) is an artist and event creator making a splash on the East Coast. She wasn’t always into cannabis, but when she gave it a chance a decade ago, it became her go-to for hang outs and unwinding. Lisa’s art has a graphic vibe that has a pop art feel and attracts people to her events—to ultimately socialize with cannabis. She told The Fresh Toast, “In seven years of doing art I have created many canvases, stickers, sculptures, prints and participated in many public art events celebrating women and cannabis culture.”

Her work has a specific normalizing and barrier breaking vibe, and she says among her most popular works are “Stickers that celebrate the visuals of Women of Color enjoying cannabis.” Cannabis and art go hand in hand for the Visine Queen, who uses the plant as an artistic muse both internally and on the page. “When I create, it has to be something I like. Something I’m ready to see all the way through. My work represents me. Usually when I’m working on art, I’m smoking a joint.”

You can catch her working on cannabis and art events in the TriState area, and on Instagram where glimpses of cool color palettes and fun social consumption set the mood for your own creative inspiration. This Queen is pushing for everyone to accept cannabis, even if they don’t use it. She says, “Art can show you another side of how a regular smoker views cannabis, to the eyes of a non-user. They might not begin to smoke but might try to be more considerate of a cannabis smoker if they enjoy the art aspect of our culture.”

Aside from being a skilled photographer, West Coast dweller Danielle Halle works in the cannabis industry with Eel River Organics as a Brand Manager. Her art uses the medium of photography to infuse a first person perspective of women under the influence of cannabis—distinctly not for the male gaze. Her own connection the the cannabis plant is a wellbeing commitment, and showing off it’s bounty is part of her life’s work.

Capturing a closeness between the plant and human, her work energizes consumption photos into an art form that too many underestimate. In the future of the industry, these skills will be in ever higher demand, but for now we get the benefits of viewing this artist’s IG feed for all the best shots. Halle says its more than smoking pics and that her work contains multitudes of the culture,”I have always been interested in photography and art, but never truly saw myself as an artist until my cannabis photography prints were being bought and sold.”

For her, cannabis is a medical aid but also an art driver, “Cannabis use also stimulates creativity and focus, which allows artists to paint for hours or photographers to edit photos all night. Shoutout to uplifting citrus terpene profiles for that late-night editing grind!”

This love for the plant landed Halle in a good place with her work as it reaches more and more people. She says, “I have always wanted to be an artist because I believe art is anything that makes a person feel something, and I want people to experience the wide spectrum of emotions that art can cultivate.”

Artists who use cannabis, who paint cannabis, draw it, or even find more unique ways to use the plant are on the cutting edge of their corner of the culture. Tomorrow’s content will be overflowing with cannabis art and imagery, but you should always uplift the artists that can make you feel it.

Meme Of The Week: Cutting Your Bagels The Wrong Way Can Really Traumatize Twitter

Bagels are pretty straightforward. There can be an endless amount of flavors and uses, but the way in which they’re cut is pretty standard. Unless we’re talking about bagel bites, which is a different conversation.

I’m sure Alek Krautman had good intentions when he posted an image of his St. Louis style bagels on Twitter. His caption: “Today I introduced my coworkers to the St Louis secret of ordering bagels bread sliced. It was a hit!”

It was not a hit with social media, which has been talking about this guy nonstop since he tweeted the picture a couple of days ago. In the internet world, that amounts to years of trolling. We’re very sorry, Alek.

After the initial outrage passed, the St. Louis style meme was born. It’s simple: people just upload photos of their favorite foods prepared and eaten in ways that disrupt the normal order of things.

Meghan Markle Has A New Palace Nickname And It’s Not Flattering

She just can’t catch a break. Meghan Markle, in addition to being blamed for the riff between her husband and Prince William, feuding with Kate Middleton, and being difficult to work with (how many assistants has she gone through so far?), the “Duchess of Difficult” has now earned a new nickname from some palace staff. And it ain’t great.

As her one-year anniversary to Prince Harry approaches (May 19), the U.K.’s premier high society magazine, Tatler, has recapped Meghan’s (nearly) first year as royalty and there are some juicy behind the scenes spoilers, including the fact that she’s been compared to Fergie, and not in a good way.

Senior editor David Jenkins says some royal higher-ups at Kensington Palace refer to Meghan as “trouble,” which is reminiscent of one Duchess of York — Sarah Ferguson, who was also heralded as a breath of fresh air inside a rather stuffy monarchy, but that “In the end, Lord Charteris of Amisfield, one-time Private Secretary to the Queen, declared, ‘She is vulgar, vulgar, vulgar, and that is that.’ Even The Independent wrote that Fergie had ‘exuberantly expensive bad taste, a voracious appetite for publicity and swallowed up large amounts of money,” wrote Jenkins.

And while Meghan has yet to garner that harsh of a media spotlight, writes Jenkin:

…staff at Kensington Palace are now calling her ‘Me-Gain’. And savvy – but well-informed and well-connected – outsiders feel she’s getting bad advice. And that that advice comes not from palace regulars, but from Meghan’s own connections.

Those connections are the ones being blamed for Meghan’s decision to let friends spill the tea to celebrity rags like People and US Weekly about her drama-filled relationships with various family members. Jenkins quotes an image expert as suggesting that Meghan needs some pros “because the advice she’s been getting is crap,” adding that it’s odd because “she knows exactly what she wants,” but that she seems to dealing with everything herself “and that’s dangerous.”

And that new nickname? Me-gain? As any husband worth his salt, Harry will be crushed. Writes Jenkins:

‘Harry’s a proud man,’ said one insider, ‘and a sensitive man. He’d be very upset at the idea of people criticising his wife. He’s utterly besotted.’

A royal source told INSIDER they believe this newest report about Meghan to be “completely untrue.”
