Is The UK About To Legalize Marijuana Ahead Of The US?

While Congress and activists met for the first time to discuss ending marijuana prohibition in the United States last week — there was plenty of “disagreement and debate,” reported Marijuana Moment — all signs continue to point toward federal legalization remaining a ways away. Though many Democratic presidential nominees favor the reversal of prohibition and two in three American support legalization, other politicians remain reticent to embrace such change so quickly.

Those over in the U.K. face a similar predicament, if a recent poll can serve as indication. Conducted by YouGov, the poll represents a “clear and growing appetite” for reforming drug laws in the UK, says the Conservative Drug Policy Reform Group, which commissioned the study.

Numbers, as they say, don’t lie. The poll shows a vast majority support medical marijuana legalization in the UK (77%). Meanwhile, those who support legalizing adult-use cannabis double the number of those who oppose it (48% compared to 24%). That’s an increase of 5%, according to Dazed Digital.

“This survey shows the government and politicians are significantly behind the public’s thinking,” Rob Wilson, CDPRG’s chief executive, told The Independent.

“It illustrates the widening gulf between the stubborn, decades-old policies of blanket prohibition and the developing attitude of millions of voters willing to apply new approaches focused on improving harm reduction and healthcare outcomes,” he added.

Whether this results in widespread change remains debatable, though that is the goal of CDPRG. The U.K. legalized some forms of medical marijuana last year, but remains difficult to access for many families due to bureaucratic and financial burdens. Wilson hopes these number could incur change in the country.

“The findings of this survey demonstrate the urgent need for policymakers and government to start to rethink policy as part of an open, fully informed and evidence-based debate on the future of drugs policy,” he said.

Why Is Big Pharma Heading To Canada For Its Cannabis Patents?

Currently, seven of Canada’s top ten cannabis patent holders are major multi-national pharmaceutical companies, according to a joint research project by Washington D.C.-based New Frontier Data and London-based cannabis bio-technology firm, Grow Biotech. The list includes Ciba-Geigy AG (Switzerland) with 21 patents; Pfizer Products (United States) with 14; and Telefonaktiebolaget LM Ericsson (Sweden) with 13. Merck Sharp and Dohme Corporation, the fourth largest pharmaceutical company in the world, has 11 cannabis-related patents, and recently announced a partnership to pursue collaborations with Intec Pharma Ltd., a clinical-stage biopharmaceutical company that has developed a propriety oral drug delivery system for delivery of CBD and THC in treating pain. This got me wondering: why are the mega companies choosing to file their cannabis patents in Canada as opposed to the United States?

With cannabis now legal in Canada for both medical and recreational use, as well as legal for medical use in 33 states and D.C. and recreational use in 11 states and D.C., it’s no secret companies are ramping up their R&D and rushing to pursue patent protection. As we’ve referenced before, data shows that the number of U.S. cannabis patent holders has nearly quadrupled since 2016. The U.S. Patent and Trademark Office issued 127 patents containing the words “cannabis” or “cannabinoid” in their claims in 2018. Similarly, the Canadian Intellectual Property Office (“CIPO”) issued 22 such patents in 2018. While numbers on both sides of the border are growing, it could be that the pharmaceutical titans are heading to Canada because the status of “marijuana” in the United States as a Schedule I substance creates patent-related issues that mega companies want to avoid (such as giving sworn statements to the USPTO that the company is, in fact, possessing marijuana in conjunction with its patent application).

On a much simpler, practical note though, they’re probably heading there because it proves to be cheaper and quicker to obtain cannabis patents in Canada. Given how rapidly the cannabis industry is evolving, obtaining patents in the cannabis field first presents several advantages (such as being able to assert your patents against competitors or using your patents with definitive claims to improve your negotiation position during business transactions).

Looking into the process, it may be a year after the request for examination is made before CIPO issues a first Examiner’s Report in a Canadian patent application. In some cases, the subsequent Examiner’s Report or Notice of Allowance may issue in about six to nine months after the applicant’s response. This means it may take a little less than two years (or more) from the time of requesting examination to obtaining a Canadian patent, which is comparable to the timeline in the United States. But! The Canadian patent system offers an excellent option for accelerating examination via a request for Special Order. A Special Order may usually be obtained without difficulty upon payment of a government fee of CAD $500 (at the time of writing this article, that’s USD $382.31). In comparison, a similar program in the United States for accelerating examination, namely the Track 1 examination program, has a filing fee of USD $4,000.

Under CIPO’s current service standard, a Special Order will get the applicant a response within two months from when the correspondence is received. Therefore, by using a Special Order, it may be possible to significantly shorten the length of time from requesting examination to patent grant.

One thing to note is that in Canada, certain subject matter is excluded from patentability. One major example: plants. Plants are not patentable in Canada because its laws provide that “higher life forms” (which includes plants and animals) are not patentable subject matter. In contrast, a cell of a higher life form, methods of making higher life forms, as well as use of a higher life form, may constitute patentable subject matter. So, in order for a breeder or grower to obtain a patent, they must be able to show that the new cannabis cultivar can be identified by technical features (like genetic modifications).

Since it’s possible to obtain patents for inventions related to cannabinoid formulations, etc. in both Canada and the United States, maybe the best approach is to build a balanced Canadian and U.S. patent portfolio. This would allow a company to protect its assets and maximize its shield against competition in both jurisdictions.

Seconds later, the one-and-only Jennifer Lopez walks up from behind her and begins her sexy, celebratory dance, which lasted for a few songs, including, “Birthday Sex” and “If You Had My Love.”

After the concert, Carli reacted to the moment on Twitter. “A first for everything,” she wrote in a retweeted post of the video.

Drake Makes An Insane Shot

On Sunday (July 15), the “No Guidance” rapper showed off his killer jump shot, while giving a look inside his 35,000 square-foot Toronto mansion. In the first of two Instagram videos, Drake gave a glimpse at his OVO-themed court from the glass window atop his roof. While the clip was enough of a flex to make most people do a double take, it was the second clip that really took the cake. In the video, Drake is shown taking, and making, a shot from his second-floor living room (yes, living room) onto his basketball court below. (You know, casual.)

According to The Blast, the 32-year-old rapper and businessman bought the 6.7 million property in Toronto’s Bridle Path neighborhood back in 2015. Since then he’s torn down the original mansion and built his own, equipped with an indoor, custom-designed basketball court.

Tips For Working Out In The Summer Heat

With the onset of summer, there are many places that experience really hot weather, which is great for several reasons, but also creates a new set of problems. Among the many perks of summer, outdoor workouts are some of the most enjoyed. They’re (more or less) fun, cleansing and physically demanding. The Sad Reason Marijuana Research Hasn’t Exploded In Canada

Around this time last year excited whispers descended north of the border. They emanated from laboratories, universities, and research centers across Canada. If you heard these hushed murmurs—perhaps in the New York Times, WIRED UK, this publication, and even The South China Morning Post—they all told the same story. Canada was poised to become world leaders in marijuana research and scientists throughout The Great White North were thrilled to participate.

Unfortunately, a passing year can make all the difference. CTV News reports that Canadian scientists are currently mired in a Borgesian complex of pending bureaucratic approval and applications. Academics must first attain a research license in Canada prior to starting research, but only 65 new licenses successfully made it through the system since Canada legalized marijuana Oct. 17. In addition, 350 existing research licenses must transition from previous legislation to the new Cannabis Act, causing delays in research.

Health Canada told CTV “there have been challenges in processing times for new research license applications.” Those are words many marijuana researchers throughout Canada understand. Another 250 research license applications also sit in varying levels of review process, with no stated timetable for their conclusion.

“Some people don’t even try because it’s so difficult,” Simon Fraser University PhD candidate Bertrand Sager told CTV.

According to Sager, Health Canada outlines numerous requirements for license approval. Some of these requirements “seems to be geared towards R and D on cannabis products, which is not what we’re doing.” They include physical security and “appropriate” storage measures, detailed “tracking of the inventory, production, and destruction of cannabis,” and more.

“Research licences are intended to provide a mechanism to authorize otherwise prohibited activities with cannabis for the purpose of research,” Health Canada said in a statement, but could not explain what “prohibited activates” researchers were participating in when cannabis was recreationally legal nationwide.

Fraser intended to study the effects cannabis use has on drivers, but has seen his plans continuously delayed. The goal was to create a driving replica that would track the reactions of test subjects to various stimuli in a controlled environment. Though the test would have remained in a lab with no actual driving taking place, Sager’s team has been unable to start research despite applying for a research license ahead of legalization.

“It’s very frustrating because when we heard rumors cannabis would be legalized we began designing the study because we wanted to be among the first out the door,” Sager said.

For now, it appears the narrative of Canada becoming a marijuana research epicenter has yet to realize. And it probably won’t be realized until Canada streamlines the process for Canadian researchers. When that might happen is anyone’s guess.

Why The NFL Will ‘Eventually Catch Up’ On Marijuana, According To Ricky Williams

Times have changed for the way the NFL powers-that-be view marijuana. In May, the NFL and NFL Players Association announced it would study using cannabis as a pain management tool for athletes. It marked a stark departure from cannabis trailblazer Ricky Williams’ playing days, but the former running back is encouraged by the slow shift in perspective.

At SportsCon2019 in Dallas this past weekend, Williams was asked about how the NFL is handling cannabis in the Legalization era. While the NFL’s announcement of its new cannabis study is a start, he believes the NFL “is eventually going to catch up” to the general public’s view of marijuana.

“Most of the time I’m up here, I’m asked a question about marijuana. Any big corporation kind of has to be behind the times,” Williams said via ProFootballTalk. “It’s public opinion, and I think public opinion has started to shift that the NFL is obviously talking about it in the public. I just think our whole country has come a long way in the past 15 years.

“The fact that before I was shunned and considered a pariah, and now ESPN invites me to talk about cannabis on television,” he added. “We’re moving forward, and I think the NFL is eventually going to catch up.”

Williams’ stint in the NFL ranged from 1999 to 2011 where he racked up more than 10,000 rushing yards, though he was suspended at various points for violating the league’s substance abuse policy. Since his retirement, Williams has embraced his role as cannabis advocate and launched his own line of marijuana products with his “Real Wellness” brand.

Players using marijuana is expected to be discussed in the NFL’s upcoming CBA negotiations. Perhaps Ricky Williams should be invited as an expert opinion on the benefits of professional athletes using cannabis to sustain their careers. Though stigma haunted him early on for his open marijuana use, he’s certainly found success now.

The Siberian Generating Company released a statement explaining how bad of an idea this is, listing all the contaminants that are present in the water. They explain that the lake is man made and that even if it’s not poisonous, it is a “high alkaline environment” that can cause reactions on the skin. The deep blue color is due to the presence of calcium salts and oxides from various metals, which you don’t want to have on you. They also say that the bottom of the lake is very muddy, and that exiting it alone is dangerous and almost impossible.

Aside from warning people, the company will also implement a 24 hour security detail who will hopefully prevent intruders from sneaking in.

Where Do Federal Agencies Stand On CBD

In the past few weeks, many opinions on the sale, marketing and transportation of hemp and hemp-derived CBD-infused (“Hemp-CBD”) products have been released by federal agencies, including the U.S. Food and Drug Administration (“FDA”), the U.S. Department of Agriculture (“USDA”), the U.S. Postal Service (“USPS”), and the Transportation Security Administration (“TSA”). While we have written on these agency policies individually, we thought it would be helpful to recap these opinions under one blog post. So where do federal agencies stand on CBD?

FOOD & DRUG ADMINISTRATION

Since the enactment of the 2018 Farm Bill, the FDA has expressly opined that the sale and marketing of CBD-infused food and dietary supplement in interstate commerce is unlawful because CBD has already been approved as a drug, and thus, cannot be concurrently sold or marketed as a food or dietary supplement. Nevertheless, the substantial public interest in accessing CBD in food and dietary supplements has forced the FDA to explore potential regulatory pathways for the lawful marketing of these products.

On May 31, the agency held a public meetingthat offered CBD stakeholders a platform to share feedback and experiences and provided the agency with information related to the cannabis-derived compound. In addition, the agency created a working group that is evaluating the regulatory frameworks for non-drug uses of CBD. The agency anticipates updating the public about its progress later this summer.

U.S. DEPARTMENT OF AGRICULTURE

On May 28, 2018, the USDA issued a non-binding opinion letter in which the agency explained, in part, that states and Native American tribes may not prohibit the interstate transportation or shipping of hemp or hemp products lawfully produced under the 2014 Farm Bill. Specifically, the USDA reasoned that state and tribe interference is prohibited pursuant to the 2018 Farm Bill, which provides that “[n]othing in this sections prohibits the production of hemp in a State or the territory of an Indian tribe, for which a state or Tribal plan is not approved under this section, if the production of hemp is in accordance with [. . .] other Federal laws [i.e., the 2014 Farm Bill]” (Emphasis added). Note that while the USDA letter is non-binding, this agency policy strongly supports the position that states and tribes should not interfere with lawfully grown and processed hemp shipments.

U.S. POSTAL SERVICE

In March the USPS released guidance on mailing Hemp-CBD products, which it clarified at the beginning of June. Pursuant to its most recent guidelines, the USPS authorizes the mailing of Hemp-CBD products so long as (1) the products contain no more than 0.3 percent THC; (2) the mailer complies with all applicable federal, state, and local laws that pertain to hemp production, processing, distribution and sale; and (3) the mailer retains records establishing compliance with such laws, for no less than 2 year after the date of mailing.

The second prong suggests that mailing Hemp-CBD food and dietary supplement would not be lawfully mailable given that these products violate the Food, Drug, and Cosmetic Act (i.e., the laws enforced by the FDA); however, this issue has yet to be administratively litigated or clarified by the USPS.

TRANSPORTATION SECURITY ADMINISTRATION

Back in May, we wrote about the confusing guidelines issued by the TSA on traveling with CBD-infused products. Shortly after our post was published, the agency revised its website, which now provide that:

Marijuana and certain cannabis infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA. (See the Agriculture Improvement Act of 2018, Pub. L. 115-334.)” (Emphasis added).

On its face, this policy suggests that the TSA will authorize travelers to carry any CBD-infused product that meets the federal THC concentration limit of 0.3 percent, even if the product is deemed unlawful by the FDA. However, travelers should understand that traveling with these products remains risky for two reasons: (1) “[t]he final decision rests with the TSA officer on whether an item is allowed through the checkpoint”; and (2) if it unclear how TSA would test products to verify their THC content. As far as we know, the TSA’s testing procedure is solely geared towards determining whether THC is present, not to measure its exact concentration.

To conclude, while the USDA, the USPS, and the TSA have all released guidelines that seem to legalize the transportation and shipping of Hemp-CBD products, these policies are drafted too broadly to completely shield carriers, mailers and travelers from enforcement actions. We anticipate – and sincerely hope – that the transportation of these products will become clearer and easier once the FDA implements a regulatory framework for their sale and marketing.

If you don’t know by now, let me be the first to tell you — NBA players smoke weed. Just last month, former NBA player and current cannabis entrepreneur Al Harrington said, “some of the best players on my teams were self-medicating all the time,” which taught him you could consume marijuana and remain productive.

Nick Young, the man of many internet memes, was recently asked by a radio host who in the NBA has the best blunt rolling skills in the league. While Young may have seen the last of his playing days, he certainly is still connected within the NBA. Which explains why Young didn’t want to snitch on any current players, as the NBA’s substance abuse policy currently prohibits the use of marijuana.

So instead Damon Bruce of 95.7 The Game’s “The Damon Bruce Show” amended his question. Which former player is the best blunt roller in the NBA, he instead asked.

“Probably Steve Kerr,” Young responded, while letting out a mischievous laugh.

This is a clever response because a) the league will never reprimand Kerr for this and b) Kerr is on the record of trying medical marijuana previously. The Golden State Warriors coach used cannabis following back pain after two surgeries.

“I’m not a pot person. It doesn’t agree with me. I tried it a few times, and it did not agree with me at all. So I’m not the expert on this stuff. But I do know this: If you’re an NFL player, in particular, and you got lot of pain, I don’t think there’s any question that pot is better for your body than Vicodin,” Kerr said back in 2016. “And yet, athletes everywhere are prescribed Vicodin like it’s Vitamin C, like it’s no big deal. And there’s like this perception in our country that over-the-counter drugs are fine but pot is bad. Now, I think that’s changing.”

NBA Commissioner Adam Silver recently revealed the league has explored players using cannabis as an alternative pain management tool, though he admits it’s a “complicated issue.”

“When we change our policy we have to be really careful because we’re clearly sending a message to young people,” Silver said. “Just like with alcohol, you have to teach young people how to use a substance appropriately and responsibly so it doesn’t overwhelm your life. It’s a complicated issue.”
