To make

ACLU Suing Cali City For Not Allowing Residents To Get High

The ACLU of California and the Drug Policy Alliance on Tuesday filed a lawsuit against the City of Fontana challenging a city ordinance that is intended to effectively prevent residents to enjoy the rights granted to them by Proposition 64 (also known as the “Adult Use of Marijuana Act” or “AUMA”). The Fontana ordinance makes it unreasonably difficult and expensive for residents to cultivate marijuana at their private residence as Prop. 64 allows.

On November 8, 2016, the people of California voted in favor of Prop. 64, which allows adults 21 and older to possess up to one ounce of marijuana and cultivate up to six marijuana plants inside their private residence away from public view. While the new law allows cities to regulate indoor personal cultivation, they must do so reasonably and cannot prohibit anyone outright from cultivating.

Shortly after the law took effect, several cities acted against the will of the voters and adopted ordinances that are so restrictive they operate as a de facto ban on cultivation. And for some groups of people, such as people with a prior felony drug conviction, it is an outright ban. In Fontana—where Prop. 64 passed with 53.5 percent of the vote and with 52.5 percent in the surrounding San Bernardino County—the Mayor and City Councilmembers even boasted that they wanted this ordinance to be the most restrictive in the state and they hoped it would to deter people from cultivating marijuana.

In addition to being unreasonable and in conflict with Prop. 64, the ordinance violates several state constitutional rights. Among other problematic provisions, the ordinance requires residents to register with the city, undergo a criminal background check, open their home to city officials for an inspection, and pay an expensive fee before obtaining a permit that would allow them to grow marijuana plants in their private home. If someone cultivates marijuana but fails to obtain the city permit they are subject to a misdemeanor even though the conduct is legal under state law.

The Drug Policy Alliance’s affiliated organization, Drug Policy Action, served as a co-chair of the Prop. 64 campaign committee. DPA is committed to making sure the measure is implemented the way that the voters of California intended.

The primary purpose of legalization is to reduce the criminalization of adults for using, possessing, and cultivating marijuana. The overwhelming majority of states that have legalized the adult use of marijuana have also legalized the personal cultivation of marijuana plants at a private residence. Personal cultivation also gives consumers a legal alternative to retail marijuana, which cannot be purchased in the state until 2018, and to marijuana in places where local governments legally choose to ban marijuana businesses. (Medical patients, however, may continue to purchase medical marijuana at dispensaries.)

City ordinances that are plainly intended to circumvent what state law now allows invite legal challenges such as this one. Local governments cannot undermine or undo what their voters and what the voters of California have embraced.

Aaron Rodgers’ shocking split from Olivia Munn has yet to result in a Rodgers family reunion.

Us Weekly reported the star Green Bay Packers quarterback has not mended fences with his estranged clan even after calling it quits with Munn, who was reportedly at the center of the Rodgers family feud.

Texas Marijuana Reform Is In Big Trouble

Although Texas marijuana reform advocates had high hopes of seeing at least one measure dealt with this year in the halls of legislature, it seems that lawmakers are still hell bent on sandbagging the issue.

There were a number of marijuana bills introduced this year, including one aimed at expanding the state’s non-functional low-THC medical marijuana program and another seeking to decriminalize marijuana possession. Both could have had a significant impact on communities in terms of redirecting law enforcement resources to more serious crime, while also stimulating the economic pulse of the second largest state in the nation.

At bare minimum, lawmakers wanted to remedy a language error tucked inside the state’s cannabis oil program that forces doctors to “prescribe” medical marijuana rather than offer “recommendations.” Since federal law prohibits physicians from prescribing a Schedule I controlled substance, it was absolutely crucial for lawmakers to correct this problem during the 2017 session.

But the bill never even got a chance to be heard on the House floor.

“We are going to see a lot more families leave the state of Texas over the next 18 months with children who have neurological disorders,” Representative Jason Isaac, one of the bill’s co-sponsors, told the San Antonio Express- News. “They will move to other states where they can get treatment.”

But the Compassionate Use Act is too restrictive anyway, as it only technically allows a small group of patients to gain access. Lawmakers argued during the session that the program should be opened up to more serious conditions, like AIDS and cancer, but that push did not manage to gain any traction either. So, while Texas might be one of those states with a medical marijuana program on the books, not a single patient will be able to track down a doctor to “prescribe” cannabis oil until the language of the law is corrected.

Efforts to eliminate the criminal penalties associated with marijuana possession also resulted in a miserable failure this year. The bill, which was introduced by Representative Joe Moody, would have simply allowed small time pot possession to be handled with a $250 fine instead of jail. The proposal was set to go before the House for a vote, but time ran out on the session before lawmakers ever had a chance to give the measure any consideration.

According to Representative Isaac, lawmakers continue to drag their feet on all marijuana-related measures because they are concerned that every step they take is one step closer to full legalization.

Sadly, all of this inaction will keep Texas out of the marijuana reform game for sometime. Since the state legislature operates under the biennial system, lawmakers will not gather again until the beginning of 2019.

“A lot of people don’t understand that Seinfeld is a dark show,” David once said. “If you examine the premises, terrible things happen to people. They lose jobs; somebody breaks up with a stroke victim; somebody’s told they need a nose job. That’s my sensibility.”

Cn yan you guess which country drinks the most whiskey? If you had to put money down for the bet, you might think the U.S. or the U.K.  They are two fairly populous countries with native whiskey-making traditions, were the biggest whiskey consumers worldwide. You’d be wrong.

It might come as a surprise that the country that drinks the most total whiskey, by a vast margin, is India. As of 2015, the south Asian nation consumes almost 1,600,000,000 liters of whiskey each year, or nearly half the world’s supply. Of course, as we’ve noted in the past, a lot of the “whiskey” made and sold in India is made with molasses, so it would be more accurate to describe it as rum.

On the other hand, since India is also the world’s second-most populous nation, with over a billion inhabitants, Indians are hardly the most prodigious whiskey drinkers on a per capita basis. That honor goes to the French, who drink more than two liters per person per year. Americans, in third place, drink about a liter and a half per year by that measure, and weirdly, Uruguay slides into second at around 1.8 liters.

In terms of share of the local spirits market, Angola is by far the whiskey-drinkingest nation—whiskey accounts for around 90% of all spirits sold there. In India and the United Arab Emirates, that figure is just over 50%.

What about specific types of whiskey? The French are the heaviest Scotch drinkers, buying around 180 million bottles of the stuff annually, or around three bottles a year for every Gallic man, woman, and child. The United States isn’t too far behind, at 120 million bottles a year. Americans do, however, drink the lion’s share of American-made whiskey, or roughly 230 million liters each year. However, in per capita terms, the Aussies just beat us out, drinking .661 liters of bourbon and other American whiskey for every .653 we drink.
