Sorry, But Massachusetts Marijuana Shops Won’t Re-Open Anytime Soon

A county judge ruled that Gov. Baker’s decision to close recreational stores was “constitutional,” while his former mentor called the move an “economic death sentence.”

Last month, Massachusetts Gov. Charlie Baker forced the closure of all recreational marijuana shops in the state to slow the spread of the novel coronavirus. It is the only state that has prohibited recreational sales during the pandemic, though Baker believes leaving stores open would attract out-of-state visitors.

Recreational marijuana stores sued Baker in response, citing the irreparable financial damage such a closure will cause. Massachusetts marijuana stores lose $2 million in sales every day they’re not in business, according to Marijuana Business Daily. Stores argued that Baker allowing liquor stores to remain open but closing recreational stores was an arbitrary decision.

Rep. Alexandria Ocasio-Cortez agreed with the opinion. Suffolk Superior Court Judge Kenneth Salinger did not, however. The judge instead ruled in favor of Baker, leaving state marijuana stores wondering when they will reopen.

“It was reasonable for the governor to be concerned that the relatively few adult-use marijuana establishments in Massachusetts are more likely than liquor stores or [medical marijuana treatment centers] to attract high volumes of customers, including people traveling from other states,” Salinger wrote. “The governor’s decision to treat medical marijuana facilities and liquor stores differently than adult-use marijuana establishments has a rational basis and therefore is constitutional.”

Former Massachusetts Gov. Bill Weld, who is a mentor of Baker’s, spoke out against the decision to keep recreational marijuana stores closed. He described the decision as an “economic death sentence” in Commonwealth Magazine this week.

“This has been widely—and correctly—viewed as a matter of social equity and economic justice,” Weld wrote. “Many such entrepreneurs borrowed money and risked all they had to open in the adult use market, which is just now starting to bear fruit. They could be wiped out if they are forced to remain closed — the exact opposite of what the law, and the cannabis commission, intended.”

Though Baker’s order allows medical dispensaries to remain open as an “essential business,” his decision stands in stark contrast to those in other legal states across the country.

“Of the 11 states and the District of Columbia that have legalized adult-use cannabis, only Massachusetts has imposed this economic death sentence on small and previously disadvantaged business owners,” Weld wrote. “In the other states, three let storefronts remain open, two are permitting deliveries, four are allowing both open storefronts and deliveries, and two have not yet launched recreational programs.”

FDA Says Zero Evidence Connecting Smoking To COVID-19

While the FDA is now backtracking its initial statement, ingesting combustible smoke could lead to more serious symptoms from  coronavirus.

Just three weeks ago, the U.S. Food and Drug Administration (FDA) announced vaping or smoking could increase risk to contracting the novel coronavirus. Health officials followed their lead and warned smoking or vaping would compromise the lungs and immune system, compounding susceptibility to COVID-19.

The FDA is now walking back its initial statement. The agency states no data links smoking or vaping to increasing your risk of coronavirus infection. However, the FDA maintains the public stance that this behavior will lead to worse symptoms.

“E-cigarette use can expose the lungs to toxic chemicals, but whether those exposures increase the risk of COVID-19 is not known,” an FDA spokesperson emailed Bloomberg Wednesday.

The agency also altered its stance on cigarette smoke from previous public statements. As preliminary studies from China have shown, serious COVID-19 infections were more than twice as likely in patients who smoked versus those that didn’t.

“Cigarette smoking causes heart and lung diseases, suppresses the immune system, and increases the risk of respiratory infections,” FDA spokeswoman Alison Hunt said. “People who smoke cigarettes may be at increased risk from COVID-19, and may have worse outcomes from COVID-19.”

U.S. organizations have been left searching for answers, as rates of young coronavirus patients in America exceed those seen in China. Dr. Justin Lehmiller from the Kinsey Institute told Mashable that one in five people (of about 1,200 surveyed) reported that they’ve incorporated something new into their sex lives since the pandemic began, mainly sexting and sending nudes pics.

But these virtual behaviors aren’t indicative of what people are experiencing in their real lives. Lehmiller said that initial data from a new study he and his team are working on suggests that people are less sexually active now, with some even limiting masturbation since the pandemic started.

“There are different things happening for different people,” said Lehmiller, “with some people just being too stressed and anxious to even feel sexual desire, but others who may be coping with stress and anxiety by increasing their sexual behavior.”

A new study published in Drugs: Education, Prevention and Policy polled 500 attendees at the cannabis event Hash Bash in Michigan, where local Ann Arbor residents and University of Michigan students gather to smoke weed in protest. Recreational cannabis is legal now in Michigan, but the event spans close to 50 years and has hardcore counterculture roots from the 70s. When researchers asked these attendees questions about cannabinoid content and effective dosing, they found wildly inaccurate responses.

“Even the people who are most enthusiastic have very poor knowledge of cannabinoid content. They greatly overestimated how much THC and how much CBD was in various strains, and what the effective dosages were,” lead author Daniel Kruger said in a statement.

The majority of participants said they used marijuana daily, with 85% saying they do so for health or medical purposes. These attendees mostly relied on their own experiences to gain knowledge about marijuana with only 23% learning from a medical dispensary or caregiver. And it shows.

When asked what the proper amount of CBD and THC was considered an effective dose, the majority said they didn’t know. Those that did respond gave average estimates of 91 milligrams and 177 milligrams for CBD, which is way off.

One person even said 1 million mg of THC was effective. That’s a kilogram of THC, enough to fill an entire football stadium and get everyone in it high.

“The average estimate for an effective dose of THC would actually be fatal in humans,” Kruger said.

Researchers also asked what they considered were percentages for high-THC and low-THC strains, then did the same for CBD. The majority (58%) stated that a low-THC strain was anything with 20% THC or higher. For those unaware, that’s relatively high THC strain. A significant minority (22%) thought anything 40% THC or higher was a low-THC strain. That, by the way, is higher than anything available on the market.

This survey demonstrates the necessity for widespread cannabis education, whether people are frequent marijuana users or just beginners.

“We really have to educate people. This has very real consequences, because these compounds have differential effects,” Kruger said. “Most Americans now live in a state where cannabis is legal, at least for medical purposes, but the information channels aren’t there regarding safe and effective cannabis use.”

COVID Emergency Relief: What Hospitals And Clinics May Not Know

While the COVID emergency bill is still in flux, one thing is certain: It’s changing healthcare for decades to come.

In late March, a $2 trillion emergency relief bill was signed by the President to elevate businesses that are being economically-impacted during the COVID-19 pandemic. The bill mandates new leave policies

For hospitals and clinics, the bill may have an impact on H.R. best practices as it mandates employer-paid leave for workers affected by coronavirus — especially those on the front lines. Employers in the private sector are eligible for tax credits as well. 

The CARES Act clarifies the paid emergency leave and FMLA-based longer-term family and medical leave sections from the Families First Coronavirus Response Act. It directs the Office of Management and Budget (OMB) that certain categories of Federal employees can be exempt from both the emergency paid leave provision (80 hours paid leave) and FMLA-based paid family and medical leave for parents of children whose schools have been closed.

The Act also clarifies that workers cannot access paid emergency leave unless they have been employed for 30 days. Furthermore, it limits paid leave for workers who were laid off before March 1 from accessing the emergency paid leave benefit.

Not only does the bill provide for fully-covered testing for individuals with health insurance, the insurer must pay one of two ways: either the rate specified in the contract between provider and insurer or the cash price posted by the laboratory.

Additionally, once a vaccine is green-lit with an A or B rating, those with private insurance are allowed any preventative service for vaccine to be covered at no cost. 

While the COVID emergency bill is still in flux, with new items being added, along with funding, one thing is certain: It’s changing healthcare for decades to come.
